In Another Attempt to Delay Hanging, Nirbhaya Convict Moves Election Commission

New Delhi| In an attempt to avoid being hanged in the Nirbhaya gang-rape and murder case, convict Vinay Sharma, one of the four convicts, has reached the Election Commission.

Convicted Vinay’s lawyer AP Singh has questioned the Delhi government’s recommendation to dismiss the mercy petition with the President by filing a petition in the Election Commission.

AP Singh has said in his plea that the code of conduct was in force in Delhi at the time the Delhi government recommended the President to dismiss the mercy petition. The petition said that when the Delhi government minister Satyendar Jain recommended to the President on 30 January to dismiss Vinay’s mercy petition, the code of conduct was in force at the time.

Advocate AP Singh said, ‘The petition has been filed in the Election Commission because the plea of ​​convict Vinay on January 30 has not been signed by Satendra Jain in the plea. Later OSD Sisodia signed a copy of the mercy petition through a screen short. When he was not an MLA, how can he use the post of Home Minister? What does the Electoral Code of Conduct say, what does the Model Code of Conduct say? ‘

Advocate AP Singh, Vinay’s counsel, said that India is the largest democracy and if such a mistake was made by the Election Commission, it should be rectified. ‘ We did not make this argument even in the Supreme Court. We have demanded to take cognizance of the Election Commission,’ he said.

On Vinay’s injury, the lawyer said that he had not hurt himself and that his hand was broken and that they will file a new petition regarding this.

All four convicts are to be hanged on 3 March at 6 am in Tihar Jail. The Patiala court has issued a fresh death warrant and this is the third warrant in the case.
