Delhi Police Files FIR Against Sharjeel Imam Over Assam Remark

The Assam Government will be filing a complaint against Sharjeel Imam, one of the protesters from Delhi’s Shaheen Bagh, for his ‘seditious’ remarks, a minister said.

A day after the Assam police filed an FIR against former Jawaharlal Nehru University (JNU) student Sharjeel Imam over his comment about Assam, Delhi Police Crime Branch on Sunday, 26 January, have also filed an FIR under section 153 (Wantonly giving provocation with intent to cause riot) of the Indian Penal Code.

Assam Minister Himanta Biswa Sarma on Saturday, 25 January, said that the state government has decided to register a case against protester Sharjeel Imam for his “seditious statement” about Assam.

“Assam government has taken cognisance of this very seditious statement,” he added. He later also tweeted the clip in question, saying that he was “aghast at this brazen attempt by this person to create unrest in the country.”

Addressing a press conference, Sarma said that clips had surfaced of Imam’s statements, in which he declares that Assam and the Northeast should be cut off from the rest of India and taught a lesson.

“A lot of wrong things have been said by this individual, aimed to create law and order situation in Assam. We will bring this person to the court so that he is punished in accordance with the law,” Sarma said, as reported by PTI.

The Assam police has also filed an FIR under the anti-terror law UAPA against Imam for his speech, PTI reported.

Additionally, ANI reported on Saturday, 25 January, that another case has been registered against Imam in Aligarh.

“He made anti-national statements at the AMU students protest on 16 January,” the Senior Superintendent of Police, Aligarh, reportedly said, adding that the case was registered based on a video of his speech and a team was being sent to arrest him.

‘Sharjeel’s Statement Twisted & Taken out of Context,’ Says His Mother

In a letter issued to the media, Sharjeel Imam’s mother alleged that he is being victimised for a statement that was “twisted and taken out of context” by the media. She further claimed that the police and authorities are now harassing and threatening their family.

“We believe in the Rule of Law and every cooperation has been promised. This high-handedness violates the basic human rights of the family members including and not limited to his elderly mother. We demand that police refrains from indulging in such actions,” the letter said.

Imam’s mother also alleged harassment at the hands of the police. In her letter to the media, she said that the authorities that Sharjeel protested against, are now harassing and threatening his family.

Further, the letter said that the constant abuse and threatening has traumatised her.Letter, signed by Sharjeel Imam’s mother “Every cooperation has been promised, this highandedness violates the basic human rights of the family members. We demand that the police refrains from such actions.”

Comments Trigger Wave of Controversy

Previously, Vivek Garg, an advocate & RTI activist, had filed a complaint to register an FIR against Imam for the alleged statements at Shaheen Bagh, ANI reported. Garg is also a Bharatiya Janata Party member, according to ANI.

The comments triggered a wave of controversy, and the clip of Imam speaking at the Shaheen Bagh protest was widely circulated on Twitter. Since 15 December 2019, Delhi’s Shaheen Bagh area has been the site of a continuous protest against the Citizenship Amendment Act and the National Register of Citizens (NRC).

The women-led protest has now grown to include violence against students, rising police brutality and the silencing of public protests among the range of issues it opposes.
